Negotiation is the basis of most commercial agreements. But collaborations do not always develop as expected. Agreements may need to be adjusted, expectations need to be aligned, and sometimes it is necessary to resume negotiations to prevent disagreements from developing into actual disputes. When dialogue breaks down, conflicts risk ending up in court or arbitration.

Why do conflicts arise?

Commercial disagreements and disputes rarely arise solely from legal issues. They are often also characterized by human factors. Conditions such as poor communication, misunderstandings, distrust and conflicting interests often also play a role. 

When minor issues are not resolved in a timely manner, they can escalate into major conflicts. Frustrations grow, and the case can quickly become a “matter of principle” that ends in long and expensive litigation or arbitration.
